Attention madera speedway commmtie. I would like to appeal the penalty from round 4 for myself and Jay. During the race there was a wreck on lap 9 shown in the photos attached that the v5,10,77 were involved in the incident. They didn’t go to the longest line when some even pit for damage. They were side by side one was in the shortest line. There was also the same incident in the jr class. I don’t feel the penalty to the 80/12 is fair when on lap 9 3 other cars did the same exact thing we did and no call the following Wednesday on them to start last in the next tv race they race in. There was no warning to the 80/12 on any race recently to where I feel this penalty is even remotely fair. Also in the drivers meeting it was talked about if you touched the line you on the chose you will get a penalty. On the last restart cars on the front row touched the line and didn’t receive a penalty. We dont feel this is right when the same thing happen in the same race and nothing is being done to those cars giving a penalty 4 days after the race we feel is not
The right thing to do is handled things the next yellow flag or at the half way break if we are going to penalize after the race then I feel 3 other cars should have to start last as well. Driver will be allowed to compete in the 10-21-23 non-point event under a hard probation condition after a mandatory meeting with the race director prior to the 10-21-23 main event. Hard probation means any negative action by a driver can result in a driver being parked for a single offense.
Disqualification and loss of all points for the 10-7-23 event, $500 fine and probation until 5-1-24 will stand as a penalty for the drivers actions on 10-7-23.

From the Race Committee - On June 18th Hunter Holden was placed on Hard Probation for the balance of the season with any negative action resulting in a suspension for the balance of the year. On June 25th he was suspended for the balance of the season due to negative actions.
Based on the Hunter Holden apology in his appeal the Race Committee has decided to reduce his penalty from the balance of the 2022 season to a two-month suspension ending on August 27th, 2022. Any negative action during the balance of 2022 can result in a 2023 suspension.

Madera Speedway Race Committee
We respectfully disagree with the penalty that has been assessed to us for slowing the pace or not accelerating at the beginning of the start area. We did not back up the field or speed up coming to the restart line unlike several others did that night without a warning or penalty. Due to the gear ratios we run, (Matt shifts from 1st to 2nd to 3rd on restarts) we always try to hold our speed on restarts at 3000 RPM and accelerate slowly from there coming to the line. There was one time during the race when Michael came on the radio and said pick it up Driver and the spotter said to give 200 RPM. Michael asked for a little more, and Matt was told to increase another 100. At that point Michael said lock it in, and we held it there prior to coming to the line and accelerating.
There were about 6-8 restarts that we were the Leader and at no point during the night did Race Control ever say there was an issue with our restarts. If there was an issue, we should have been told that the Tower didn’t like the starts and to give us an opportunity to correct the situation. The Tower not saying anything led us to believe that everything was fine.
We feel it is unfair to establish a new precedent of penalizing a team post-race for what has been considered a balls and strikes call in the past.
Team Erickson feels that it is unfair for this penalty be passed down to us post-race, and we feel like it should have been handled in race if there was in fact an issue.
We are requesting that this penalty be overturned or at the very least reduced to a warning.

After further review by the race committee that included additional camera angles from the television show, the penalty issued shall stand. Four bullet points from the decision;
1. The driver clearly began his acceleration past the area in which he was to start his acceleration at.
2. The driver slowed down on the pace lap before the restart in which he was penalized for.
3. The driver was told to increase his pace speed on two restarts prior to the restart he was penalized for.
4. The race committee has and will issue decisions/penalties via post-race reviews in areas such as post-race technical inspection and race procedures such as this case. This is consistent with past reviews, an example is the Ryan Philpott post-race victory decision in 2020 that took place by the race committee after the event.

Race Control Officials / Race Director, Flagman, Track Steward and Tower spotter official
Missed Call by race control, the 28 car of Trevor Schlundt spun and caused a caution and should have gone to the rear of the field for the restart, but the 28 driver went back to the fourth position and restarted the race without race control correcting the error.
Action; All four race control officials will be required to do a one lap foot race (probably a high speed walk) around the Madera Speedway on August 21st and the official that comes in last will be required to clean the grandstand restrooms after the event. Key thought, when running from a bear in the woods you don’t have to be the fastest among your friends, you just have to outrun one of them.

To whom it may concern.
Regarding the penalties received for the number 58 MST on 5/22/21.
I do not believe that the on-track actions stated are correct.
I respectfully ask you to reconsider the penalty given to the number 58 MST.
You stated, "unsportsmanlike conduct".
This Is not entirely accurate by leaning the penalty more towards the #58 and not split fairly between the #2 MST/ #1 Haley Bugg. The actions were both equally done if not worse by the #2 MST unsafely brake checking me leading to the biggest contact between us. I have video proof that will be submitted in this response. I do not agree with the unfair penalty and and would like to respond to this penalty and request a fair and equal penalty in this situation between the two of us. Below is my side of this on track incident.
Yes after how I and the #06 MST were being raced by the #1/#2 MST I was angry at being repeatedly doored or wrecked by the #1 car and how she has without penalty consistently made on track contact with me all year.
After the race on the cool down lap, I did pull up behind her to show my frustration. I had no intention of making contact.
However the #1/#2 car let off the throttle causing the first slight bump and then proceeded to slam on her brakes. THAT is what caused us to make hard contact and come to a stop on the backstretch.
I have GoPro footage and will be sending videos from the front of my car to prove this.
I strongly feel this is the only action worthy of penalty from that race for the #58.
You also stated "retaliation for race conduct under red".
Respectfully I believe this statement is also false.
The red flag came out when the #1/#2 car again, made contact with another competitor on the straightaway. This caused the car behind them to wreck into the wall bringing out the red flag.
My video footage shows that in no way did I retaliate that anytime during the stated red flag, or when we went green again.
You also stated "retaliation under caution".
This caution was again caused when the #1/#2 car was attempting to pass me in turns three and four on the outside. She turned down too far making contact with my car causing her to spin in front of me, and me to come to a stop with her. My GoPro footage from the front of my car will show you that this is exactly what happened and I in no way retaliated after that.
I did speed up down the front stretch to go around her to get my spot back, and catch up with the field. I in no way made contact with her when I passed her under caution. My GoPro footage will also show you this.
I respectfully ask you to consider the facts that I have presented and review the video footage that I am sending.
Please keep in mind I have raced there since 2008 in different classes and I have never once been in the penalty box.
Please reconsider your penalty for me.
All I am asking is that you do not take points from the #1/#2 car or the #58 for that race, as well as lifting my One race suspension.
The #1/#2 car and I have a great points battle going on for the championship. And this unfair penalty would ruin this.
As we try to save/rebuild this class, I believe this points battle, with two new names at the top is extremely beneficial.
I do apologize for my actions on the track, and again please consider the facts that I have stated and the videos I am sending regarding the penalties received, so we can continue this close battle for the championship.

I’m attaching two videos that show me being struck from behind several times by the #1 car under caution leading to the restart before the crash. On the restart I entered turn 1 behind the #2 car, as we started to exit the turn I was again, struck by the #1 which sent me perilously straight towards the turn two wall/gate. I turned the wheel to the infield as hard as I could to avoid contact with wall. My car snapped loose sending me into the path of the #1 car, which then caused us to crash into the wall on the back stretch. I obviously made a huge mistake with what occurred afterwards. I hoping to be allowed to race in the next event, and have my points reinstated from the last event. So that I can continue to compete for the chance to win an MST championship. I will still pay all fines more or less rendered, and remain on hard probation if possible. My goal this year was to be a calm driver, and just have fun after spending all off season trying to rebuild the class. If I act in this manner again, I give you my word I will no longer drive a race car. I will try a different avenue as a rental car owner.

P.s. Aaron and myself spoke promptly after the race. There was no confrontation. We both explained our sides about what had happened, and proceeded to shake hands, and return to our own pits.
Because of this appeal the race committee requested and reviewed all the aspects of the unsportsmanlike conduct via video content.
The race committee came to the ruling below on the appeal;
Statement from the race committee; the penalty issued was due to the actions of the 21 MST driver after the wreck took place and had nothing to do with the racing incident. The majority of the appeal deals with what took place while racing, not with what took place while the safety crew was attempting to help the drivers.
The driver was suspended last season for dangerous actions after an accident as well. The original ruling was to suspend the driver from the speedway for the entire 2021 season due to his past history, but that was reduced to a one race suspension as a driver and hard probation for remainder of the season.
The penalty will stand.

#04 Jr Late Model / Protest of Disqualification from 10-17-20 race for Unsportsmanlike Conduct
Below is the explanation of the unsportsmanlike conduct as requested from the 04 team via email;
Cole Brown was disqualified from the event on October 17th for unsportsmanlike conduct.
The unsportsmanlike conduct occurred after the checkered flag under a caution flag and then again in the victory lane area. The 04 car made contact with the 22 car on the cool down lap under caution going into turn three and then made contact again in victory lane after driving far too close to the 22 car coming into victory lane and then remained at the 22 car in victory lane until track officials pushed the car back.
Although this is not part of the penalty, it is noted that the 04 car also drove away prior to the interviews being completed causing people to move and photos to be stopped by the 22 car and inserting unwanted additional sound into the TV interview of the 07 car.
As reference, there have been many penalties for retaliation, contact and actions by drivers while under a caution flag and these actions are not acceptable and will be firmly dealt with in an effort to keep everyone safe at the Madera Speedway. During a caution flag condition we often have safety workers, fire fighters, drivers and others on the race track and a very dangerous situation can occur if drivers are not respectful of the caution flag condition.
Pro Late Model driver Matt Erickson was fined $2,500 and disqualified, and suspended for six months for hitting another car under a caution flag in 2020. MST driver Patrick Geiger was disqualified and suspended for the balance of the season early in 2020 for hitting another car under caution, Shelden Cooper was fined $500 for getting out of his car and make an aggressive move towards another driver under caution in 2020.

Dear Race Committee:
I, Jim Brown, hereby PROTEST the disqualification of my minor son, Cole
Brown, from the 51 FIFTY Jr. Late Model class race that took place on
10/17/2020. I am protesting the decision as the car owner in this matter. It is my understanding that Cole has been cited for "unsportsmanlike conduct" for making contact with the #22 car "on the cool down lap under caution going into turn three and then made contact again in victory lane and then remained against the 22 car until track officials pushed the car back. " I am making this protest in conjunction with Cole Brown's letter of today's date.
I wish to protest the decision based upon the "unsportsmanlike conduct" that was exhibited toward the #04 car the night of the race that is the subject matter of this dispute. After being intentionally ran into and pushed up the track over and over on the final laps of the race by the #22 car, Cole continued to become angry with the conduct against him and was frustrated that there was no attempt from officials to mitigate or deescalate the rough driving and no penalty given to the #22 car for his conduct. Therefore, minimal contact was made after the race had finished under the caution flag. He is sorry that he allowed himself to get that worked up and apologizes for the contact in his protest letter. He also stated that he would not have put any safety worker, fire fighters, drivers and others at any type of risk.
As for the "contact again in victory lane," that allegation is disputed completely. When I got to victory lane, the officials seemed to be in a hurry to get the #04 car backed further away from the #22 car. At that time, I asked what was going on and was told that the cars were too close together and they needed to separate them. One of the officials handed me a piece of debris off the track and I asked if the #04 made contact with the #22 knowing they were very close together. He said, "no the #04 did not hit the #22." I did not see any contact in victory lane at all in all the videos that we have watched.
In addition, regarding the allegation that #04 "remained against the 22 car until track officials pushed the car back," that is disputed since there was never contact with the #22 car in victory lane. In the Madera Speedway Facebook live video, it is clear that an official is actually standing between the #04 and #22 car before the #04 car was pushed back.
Our team apologizes for any interruption in the #07 driver's interview that night. It was never our intention to disrupt the #07 interview nor at that time knew that an interview was still going on. We simply needed to remove ourselves from the negative situation and get to tech because we had to drive home that night after the race.
Lastly, #04 felt he had no choice but to stand up for himself on his own. Maybe he did not react in the manner that some would consider as proper; however, he did not receive proper treatment for several laps just moments prior. His action did not cause #22 any physical harm, nor did it cause him to lose the race, prize money, or placement in series points, which is exactly the penalty that this disqualification causes to #04. There were many unfortunate events on the night of 10/ 17/2020 by numerous people. The #04 did not intend to harm anyone by his action. I am still not quite sure what you would expect from any young driver that is put in that situation to do if he or she feels like nothing is being done to deescalate the problem. The penalty of disqualification is one that outweighs the actions of the #04 driver on 10/ 17 / 2020.
I hope that the committee can really look at the entire scope of problems that have been going on internally and externally on and off the track and realize there are much bigger problems that need to be addressed for all of the young drivers to succeed in the growth of our sport. I hope that you will strongly consider reversing the decision regarding the disqualification of Cole Brown from the 10/ 17/2020 race.

This letter is my (Ryan Philpott) formal protest of the finishing position of the race 2B drug free round two. The call made stated the start was coming back. What I saw in the car and on camera is the green light was still on during the wreck. The 51 and 75 crashed out and the 81 took out the 50 which was the race leader. I got through the wreck unscathed and ended up behind the 81. I believe the 81 should be sent to the tail end of the lead lap and the other three cars where all involved in the caution therefore resulting in the 52 (me) getting the win. I am asking the oversight committee to please review all footage and audio of the situation to see if you agree with the outcome. Thank you for your time.

The race committee reviewed the finish of the race and came to the ruling below;
The final restart was called a jumped start by the flagman as the leaders went past the flag stand, in the past the green flag would have never came out but due to feedback from race teams we now put the green flag and green light out for safety reasons and then put the yellow lights on when it is safe to do so to call the start back.
As the leaders were in turn two they wrecked while under a safety green flag and race control and scoring determined the finish of the race as if the last start never happened due the green flag only being out for safety reasons.
The race committee had a focus on two areas since this was a new situation they had not seen before with a race ending on a blown start, with the leaders wrecking just as the clock strikes a firm curfew time.
The areas of focus were;
Did the drivers know they were under a safety green or where they racing?
What would the lineup for the restart have been if we had been allowed to complete the remaining 19 laps of the 100 lap scheduled race?
After much debate by the members of the race committee it was determined that even though it was a safety green flag the drivers were racing and those involved in the accident would have gone to the rear of the field for the next restart. The 81 would have gone to the rear with the 50 for spinning him, and the 75 and 51 would have gone to the rear for being in the wreck if they could have continued.
Ryan Philpott has won the protest and the race finish will now reflect the 52 car as the race winner with Joey Iest in second, Seth Wise in third, Eric Nascimento fourth, Shelden Cooper fifth, and so on.

Dear Kenny Shepherd and Madera Raceway,
I would like to formally apologize for my team’s decision on the weekend of October 5th 2019, as well as ask for the release of my current suspension from racing at your facility.
After the conclusion of last years $10,000 to win short track shootout where I finished 4th place, my team was asked my Madera raceway officials to remove our engine for further inspection. As you can probably recall, we elected to refuse this request due to our shortly upcoming commitments to race at our home track All American Speedway 7 days later. With being in the middle of a heated points battle in Spears Southwest Tour, which accounted for about 95% of our weekly/ day to day preparations we didn’t have the time or resources to turn around and re-install a motor within that short of a period and still be able to race our late model at All American Speedway the next weekend.
Ultimately, I know Madera raceway is a respected facility with respected staff and must toe the line of its rulebook and consequences. Considering this, I am hoping that due to my set of circumstances, and with JM Racing recently paying our fine to Madera’s Children’s Hospital that Madera speedway will release my current suspension so JM racing can have the option to come and race with you all in the earlier part of 2020.

Note, all other cars that finished in the top five passed the GM seal certification during Friday inspection, the 20 team was told on Friday that the engine would be removed if they finished in the top five on Saturday. We have taken six different engines to our GM inspection facility this year for a dyno test and a manual cam profile as well as other testing that does not require us to pull the engine apart. If the 20 car engine passed the inspection at the test facility it would have been returned to the team by Tuesday of this week race ready. If the engine failed this inspection, then the engine would not be returned to the team and the driver and crew chief would receive a penalty that could include a lifetime ban from the series.

This sample does not conform to the speedway submitted benchmark scan of the of the Sunoco E85 race fuel. This sample was analyzed in duplicate and the duplicate analysis did not conform with benchmark. This is a laboratory quality control measure to ensure quality of sample results.
Below is the chemical found in this sample that is not found in the speedway submitted Sunoco E85 fuel sample:

This chemical is the reason that this sample does not conform to the benchmark sample. This chemical is a fuel oxygenate.
Action; Driver is disqualified from the May 25th event. Due to the fact this is a second offense driver and crew chief are suspended from competition until November 1st, 2019. Team owner is fined $2,000.00, plus will be required to pay $1,000.00 for additional fuel analysis of track fuel, car fuel, shipping and time involved in this process.

Attention 51FIFTY Jr Late Model and Nut Up Pro Late Model Series Teams
All prize money is held until the post-race inspection process is complete. For the May 25th MAVTV races the fuel and tire sample analysis were completed on June 4th, the engine inspection was completed prior to that date.
A car failed the fuel inspection process and that has triggered additional testing procedures such as the testing of samples from all barrels of track fuel used on May 24th, 25th (we send a sample from one barrel as a benchmark as standard procedure).
This additional testing will take another one to two business days, so to help our teams we have decided to mail all checks to all teams except for the team that failed the inspection process. If needed, we will adjust all payouts and points once this is finalized next week.

#73 RPM Pro Mortgage Open Late Model/Garland Tyler Appeal
On 9/23 the Race Committee received the following Appeal the #73 Team in regards to their finishing position:
We (Garland and I), would like to appeal the finishing order of this race. We took the white flag in the 6th position just prior to the crash between the 90 and the 11. Garland had no choice but to come to a stop in turn 1 to avoid crashing into the cars involved or the wall. When the white flag is displayed, the next flag ends the race. We strongly believe we should be scored in the 4th position because we were not involved in anyway. We do not race back to the line when the caution flag is displayed, therefore the field is frozen minus the cars that were involved in the wreck. If the scoring stands as it currently is, this will only create more confusion with all drivers and promote racing back to the caution on the last lap. Thank you in advance for your consideration regarding this matter.

Response from the Race Committee:
The 73 car came to a complete stop on the track during the white flag lap. The race does not revert back after the white flag is displayed and cars are scored as they cross the finish line at the checkered flag with no cars passing after the caution is out. All cars must maintain their position under caution and continue back to the checkered flag where the race will be complete. If a car stops during the white flag lap they will be scored in the position they cross the finish line. If a car is involved in causing the caution during the white flag they will be moved to the rear of all cars on the same lap.
The finishing position will be adjusted to reflect a 14th place finish by the 73 car due to the fact that #11 car was involved in causing the caution. The 45 car was also moved back to 4th position for passing under the caution flag on the white flag lap.

I Patrick Geiger, would like to start off with the
deepest sympathy and apologize directly to Dave Landers and all others involved for an unfortunate mistake on my behalf. I would further like to give my statement and request an appeal to the decision . It was never my intent to intentionally cause a crash on a race track or between Dave and I. The lap leading to the crash we had a good battle. I got loose in front of Dave coming to the checkered in turn four. We then made pretty significant contact in the rear between dave and I. This causes both of us to check up loosing a large amount of speed. When I looked in my mirror Dave was not there and had not passed me. I just I did not see him coming with so much more momentum. I thought he checked up completely! It was my intention to moved up to get in front just before the finish line since we were feet from it! I did not realize he had gotten so far alongside me and carrying as much speed as he had. I take complete and full responsibility for this mistake. It was never my intention to wreck the cars we work so hard on. I to apologize to the track for my laps in judgment. I would like to request that my $100 fine go's to David Lander and also to appeal the penalty decision. Dave Landers and I are friends and have had a chance to talk. Please
consider my appeal for review. Thank you for your time!

To whom it may concern , I Thomas 301 First in no way was it my intention nor was it retaliation on my part to be involved with setting site to be part of a wreck . To have & create an assumption that i was out for retaliation is just not true its an assumption and the assumption would have to be based on that Kern was knocking me around a number of times the last was in lap 29 when Kern brushed me against the wall and i fell back a car length , that being said at no time did i have any thought of retaliation its racing i had Mike Marley to contend with now to retain the third place position going into last lap . is was my race goal . Kern had 2nd was no need to challenge that. Mike was on my tail for the last 11 laps. Moving foreword last lap going into turn 3 i go low following Kern's Path & behide me following my path is Mike , were spaced about a car length between us , as we inter thru half of the turn Kern slowed which i tapped brakes could not do hard for Mike was directly behide me i could not go around Kern for it was to late . If i would of slammed on brakes Mike would of reared in me and i still would of ended up into Kern. Perhaps Kern's car got loose i don't know it would be a assumption but i can say it was never my intention nor did it inter my mind to retaliate why would i set out to wreck my car or anyone's car or the guy further back which ended up wrecking my car to which had a window of opportunity to avoid hitting me . I understand its racing and the unforeseen is going to happen its racing there is many variables that can happen & do happen that's racing . One can not allow feelings & emotions to be part of racing & the process or decision making on Penalties and Punishment , Otherwise it becomes a bullying means. and penalties and punishment will not change the driver because of a assumption from others. I read plenty of that . If i am being viewed as being involved as in retaliation because i go to the bottom of a corner well then i'll never be able to race because im restrict from racing , racing is racing and things happen. And when i left track i went to my pits and stayed there said nothing . I could go on but i think i said enough . So conclusion is that i would like suspension reduced to probation at the max if at all , also i'll be willing to pay 50 bucks to a charity of the Race tracks choice . So I am writing to question this penalty.my first yellow was a solo spin by myself and no contact with any other car.second yellow was when the 6 car spun off turn 4 and locked up brakes and spun to avoid any contact with him.and there was no contact before during or after between me and the 6 car.i believe that should not of counted as involved. As I was avoiding a spinning car.and I will enclose a text message from the 6 car pretty much saying the same thing and thinking me for not whipping out both cars.he even walked over to our car and shook my hand Saturday night thinking me.the last yellow.ok me and the 44 car did make contact not intentional.he spun and stop from hitting him.so I don't see anything justify a $100 fine.i walked over to talk with Dave Pereira and Anthony blessio after the races and do was talking and laughing and asked.is everything good i didnt

The below Appeal was filed by Herzog Motorsports on 9/13 in regards to the severity of the Penalty assessed to Austin Herzog. This appeal was then dispersed individually in sealed envelopes and in confidence to a different 5 member independent Race Committee consisting of a former Promoter, current /ex Drivers, and Officials for review and decision. Each member then sealed and initialed the return envelope and sent them back to the Speedway with their decisions. The sealed envelopes were then opened and tallied with a witnesses present.
The results were are as follows: The Committee has voted 5-0 in favor of the Penalty to be upheld.
To Whom It May Concern –
Speaking on behalf of Herzog Motorsports and Austin Herzog, I would like to take this opportunity to speak to the incidents that led to our removal from the RPM Mortgage Pro Late Model Series. We are writing to appeal the penalties handed down. We regret how this saga has impacted all parties involved – whether that is the sponsors, Herzog Motorsports, fellow competitors or Madera Speedway. Our part in the incidents can be limited to just the on track activities that took place. We have admitted fault and taken responsibility for our part of what has happened. We recognize the privilege to compete in this series on MAVTV. But we do not endorse the way this situation was handled by track management. The way this has been dragged out in social media is something that track management has encouraged drivers not to do. It was very unprofessional and damaging to our reputation.
Austin has been given a lot of attention that he has earned with 5 Junior Late Model wins and consistently a top-3 car in the Pro Late Model division. The original PR by Madera Speedway on the Facebook page was very disparaging towards Austin, attacking his personal record in the Jr class this year and also attacking the pressure he has been under. A large amount of the pressure on him has been laid out by the series officials and promoter through coaching and talks in their tech trailer and on social media. It is unfair to ask our driver to race hard but penalize him for racing incidents that occur as a result.
My hopes with this appeal is to share our opinion on the outlined events on your “highlight reel”. I will break them down into five different incidents, explaining our position on each one. We would like to see the suspension reduced to a probation for Austin Herzog to compete in the final two RPM Mortgage Pro Late Model Series races of 2017. We believe his development will be better served in that division.
#1 Spotting and Audio – This part of the video seems unfair to our team. It shows the 45 car on the hook destroyed while airing audio that has nothing to do with that incident!
As for my spotting, what verbage I use is between my driver and I. Only he knows what my verbage means when I tell him to “hold him down” I am only telling him to take away the advantage or the preferred line of the car on the bottom. It is meant to slow their entry roll into the center and their exit grip. At this point it is up to the driver on the inside to slow their entry to not push up into the center. It is also up to them not to spin the tires off the corner as they are held down from rolling off the corner. Never does this mean to put them in the grass or in the rumble strips. Now the exact opposite goes for “push them up”. This technique is only used when needed and only used when racing with trusted drivers. This is commonly used in the higher level of racing seen every Friday, Saturday, Sunday with the big 3. Point is Austin has never directly wrecked a car as per my spotting. To use this audio when showing the 45 car on the hook is a blatant lie and can only be seen as a means to destroy our reputation.
#2 Buddy Shepherd Incident – When this TV Show aired, the commentary clearly talked about the 22 being a heavy big motor car and 11 being a 602 light weight car. And that Buddy will have a hard time keeping his tires under him at the pace Austin was pushing him to. This came to be true as Buddy came to be looser as race went on. On the last lap I did instruct Austin to loosen him up as need be. As they entered turn 3, Buddy slowed more than previous laps and Austin rolled super deep and got on his gas earlier, spinning him out. This incident was 100% Austin’s fault and we have never contested that. We have accepted all responsibility and used this as a learning tool. Like Kenny and Dave said their tech trailer, we should have bumped him on entry not exit. The cars that came along later should never have been involved. It is regrettable that they could not manage to avoid what many others did avoid. It was almost as if they were racing back to the checkered yellow. Racing back to the yellow has been a common confusion in the series and not something that can be laid on Austin.
#3 Kyle Gottula Incident – We are at a loss on this one. Only one camera angle was shown… Even with this poor angle you can clearly see Austin is spinning to the left before ever making contact with the 71. After talking to Kyle after the race, he said his car was loose and he didn’t think Austin had spun him. I would have to believe to be the case as the video didn’t show any angles that show who got loose and who hit who.
#4 Logan Zampa Incident – I don’t really post blame on anyone here just good hard racing. It was very early in the race for this incident, however. There was give and take that could have been shown by all the drivers involved and it nearly ended Austin’s race too. We apologize for our role in this incident but not for the aftermath. You can clearly see Logan come across Austin’s nose and Austincome up the track as not to spin him and put him in the wall. Once Austin let off the gas and kept himself out of the fence, he veered left from keeping it out of the fence himself. At the same time, Dillon Tucker was moving up the track where the 88 and 11 made slight contact causing the 88 to get a flat. Matt Erickson was right behind this and was able to avoid it. The video purposely doesn’t show how the other drivers ended up in a pileup. I’m not sure why with spotters and drivers in a pro division, how the car right behind the wreck and the one following him can miss it but countless others can’t. The cars behind a wreck need to be held accountable for a wreck that was a straightaway behind them. We regret that so many cars were involved in this incident but it should have never gotten that way.
#5 Jason Aguirre Incident – This is also just a racing incident gone bad. I don’t know anybody who hasn’t gotten loose on a restart at least once in their career. Plain and simple Austin gets loose and chases his car up the track. Austin lifts, corrects it, gets loose again, and now he’s completely in front of the 45. Jason never lifts, runs right over Austin. At the same time, he was hit in the left rear by the 73. Austin clearly gets loose and if the 45 just lifts the crash is avoided. The cars behind this should also be lifting to avoid the wreck like the 26 did. Unfortunately for the 26, the 27 (who was even further back) never lifts and nearly flips the 26 over. Now again at some point these cars in the aftermath need to be held accountable for their own actions.
In closing, we acknowledge our part in these incidents but feel in no way that Austin or his spotter are doing anything that warrants a penalty. Nor do I feel we are incapable to be in your show. There are far more cars and teams that should be pulled from competition due to being involved in wrecks that should be avoided or who caused wrecks driving over their heads or thru the bottom half of their windshield.
We would like an appeal that allows each committee member to see both the published video but also laps prior to each incident. We would also like the judgment to include the individual responses from each member of the committee so we can better understand whatever the decision may be.
We feel this entire situation has embarrassed the sponsors of both our team and the track and has embarrassed the entire Madera Speedway. This public display of the incidents has a negative impact on all parties involved and that can be resolved by reducing our penalty and an admission of fault by all parties involved. Everyone in this case should learn from this including the race track management.
Our conclusion is that we would like to see the suspension reduced to a probation for Austin Herzog to compete in the final two RPM Mortgage Pro Late Model Series races of 2017.

#22 RPM Pro Late Model/Buddy Shepherd
After review of the DQ that was issued following the Post Race Tech Inspection on 5/27, it has been determined that the engine set back measurement procedure used was not performed in way as to determine a precise measurement of the engine setback. The DQ is rescinded and all points earned for that day will be reinstated.

Inappropriate conduct with an individual. Dennis Saunders took the headphones and radio off of RPM Mortgage Late Model Crew Member and dropped it on the ground while in the Hot Pit Area.
Action: Dennis Saunders is banned from the Pit Area for the remainder of the 2017 Season.

Failure to Pass Post Race Technical Inspection:
The top 5 finishers were impounded for a Post Race Technical Inspection, which included, but was not limited to the inspection of the Ignition System, including the Wiring, Distributors, Ignition Boxes, and an Engine RPM/Chip Test. The # 24 car Failed this Inspection Process.
Action: The #24 Jr Late Model was Disqualified from The Main Event and will receive no Points for the Day Events.
#24 Jr Late Model / Jason Silliker
Unsportsmanlike Conduct:
During and after Post Race Technical Inspection, #24 Crew Member Jason Silliker exhibited unsportsmanlike conduct toward Officials, that included, but was not limited to Verbal Abuse.
Action: The Crew Member involved, Jason Silliker is suspended from the LoanMart Madera Speedway until July 1st, 2017. He will remain on probation throughout the 2017 racing season.

mission to offer wholesome, thrilling, and intense entertainment of the highest quality; through affordable,
equitable, and competitive racing of intriguing and unique racing machines; while giving back to the
communities we entertain. Furthermore, the CSS takes great pride in our professionalism, maintaining the

further accentuated by the opportunity to entertain some of the best race fans around while racing at
LoanMart Madera Speedway, one of the premier asphalt short tracks in California, with topnotch staff and
crew that are second-to-none.
Unfortunately, during the CSS Main Event of the 45th Harvest Classic on September 17, 2016, an infield
incident occurred that not only failed to pursue our mission, high standards, principles, and expectations, but
violated multiple Series rules, most notably the Rules of Conduct. Pursuant to those failures and violations,
the #7 Hays Bros Racing Team is suspended indefinitely from ANY participation and/or competition, effective
September 17, 2016.
Furthermore, the entire team & driver is suspended from any event at the Madera Speedway

After reviewing an Appeal by Howard Holden in regards to the incident that occured on 6/20/2015, we have come to the following decision:
Taking into consideration the events that occured that night and previous incidents regarding Howard Holden, the penalty assesed will stand. Howard went out of his way to confront Barry Patton at the end of the Toyota Sedan Main Event. Howard instigated the events that occured by blocking Barry's path of travel to the Infield Pit Area, pointing his finger in Barry's face while yelling and using profane language due to his displeasure with a racing incident that occured during the Main Event involving one of Barry Patton's car. This resulted in a physical confrontation that also continued later on in the Pits when associates of Howard caused another disturbance in the vicinity of the Patton Pit Area.

Driver was involved in at least 4 separate incidents during the Toyota Sedan Main Event including passing before the start finish line, and rough driving with competitors. After several warnings from the Flagman, the Driver continued to drive reckless and blatantly wrecked the #25 sedan, driving right through it without lifting.
Action: Driver was parked and DQ'd from the Main Event resulting in loss of points. He will be placed on Probation for 3 races and fined $25 dollars which will be donated to the Children's Hospital. Any further action of this nature will result in a minimum of a 1 race suspension and a heavier fine depending on the situation.

While I realize my actions reflect negatively on myself, my team and the track, Im hoping you will give me the chance to show I wont let this situation happen again. " The Driver will serve the 1 race suspension and not pay the $100 fine

1/17/12 Madera Speedway/Short Track Management has received apology letters from both Donnie Large Jr. and Donnie Large in regards to their actions on September 17, 2011. They have also asked for re-instatement to Madera Speedway for the 2012 season. Are decisions regarding this matter are as follows:
Donnie Large Jr. - After reviewing the apology letter and taking in consideration his previous disciplinary history (probation/no fines for Rough Driving on two occasions over the past 3 years), we have decided to allow Donnie Large Jr. to compete at Madera Speedway for the 2012 season. He will need to pay a fine of $250.00 dollars and will be on probation for the entire year. Any rule violation or inappropriate behavior may/will result in immediate suspension for the remainder of the year.
Donnie Large - After reviewing the letter sent by Donnie, we have come to the decision that Donnie will not be allowed to participate in any Madera/Chowchilla events during the 2012 season. He will be allowed to ask for re-instatement in 2013. This decision is based on the following disciplinary history:
2008 - 3 total infractions/$450 in fines - 1 for fighting
2009 - 3 total infractions/$150 in fines - 1 for fighting
2010 - 2 total infractions//$100 in fines - both for fighting
2011 - 4 infractions/$50 in fines/ - 1 for fighting
9/20/11 Madera Speedway has reviewed the appeals filed by both Donnie Large and Donnie Large Jr in regards to the incident on 9/17/2011. After taking in to consideration these appeals, the statements filed by both Madera and USAC officials, security,witnesses, as well as previous incidents involving Donnie Large, we have determined that the penalties will stand.
Madera Speedway will not tolerate fighting or any type of unsportsmanlike conduct by any individual(s) whether they are in the pits or the grandstand area.
Our goal is to provide a safe, family environment for everyone, whether they are racers or fans.

Effective Immediately
Due to the immature behavior from a few of the Toyota Sedan drivers and a handful of the Toyota Sedan fans we will eliminate all of the trophy presentations for the sedan class until further notice. An appeal was sent to the committee by the 26 Toyota Sedan in regards to their penalties incurred on 4/19. After review, the committee has decided that the penalty will be reduced from a DQ/ loss of points to last place finishing position.

Review and ruling of the Erickson Racing Team Appeal;
1- Striking an Official(s), the ruling was made on 5-9-11 that Matt Erickson had struck an official based on the race director's race report. Upon receiving your appeal it was requested that each official and the security staff members involved give a written account of what took place. Note; these written reports may be read at the conclusion of this report. Based on the reports given by the individual officials and the security guard, the race committee has come to the conclusion that more than one race official was struck, and the driver acted in a much higher degree of inappropriate conduct than the committee was led to believe by the race directors 5-9-11 report. Therefore, the penalty would have been greater than what was issued on 5-9-11 had the race committee had this additional information.
2- Reckless Driving, this could easily be called a racing accident but the amount of early race aggressive driving is a problem in this class and the race committee has been instructed to deal with this problem firmly. Although this was only 15% of the total penalty and nothing to do with the suspension whatsoever.
3- Unsportsmanlike Conduct - You answered this one yourself, yes there was unsportsmanlike conduct. Since our review the level of unsportsmanlike conduct was more severe than the race committee was led to believe by the race director's report on 5-9-11. It was learned that there was additional cursing towards the other competitor and officials by Matt Erickson. It was also learned that he failed to adhere to the request of multiple officials. Plus it took a security guard to keep him from getting into an additional altercation in the pit area. It was also learned that Matt Erickson was in a very aggressive frame of mind long after the race as evidence would show when his Father requested to remain in the post-race driver's only meeting due to the fact that his father felt his son would quote "kill someone" if he were left alone. Therefore the penalty would have been greater had the committee had this additional information on 5-9-11.
The Madera Speedway race committee rules that the penalties and fines will stand as issued on 5-9-11.
Race Official's and Security Report on 5.7.11
On the evening of 5/7/2011 at approximately 9:26pm Matt Erickson, the driver of the #42 Late Model was involved in a crash with Roger Selsor, the driver of the #39 Late Model, on the back stretch of Madera Speedway. Both cars were damaged severely and could not continue.
Our officials arrived immediately on scene. John Williams went to the #39 car first to check if he was ok. Mr. Selsor stated he was Ok. John then went to the #42 car and was confronted by the driver, Matt, as he was getting out of the car. Matt then stepped around John and ran to the driver's side window of the #39 and begin to swing and strike Mr. Selsor while he was still in his car. At that time, John pulled Matt back and stepped between him and the car requesting him to leave the track. Matt responded by straight arming John in the chest, knocking him backwards. Robert Koop, another official, then stepped in to escort Matt off the track. Matt turned and pushed Koop back violently with both hands. Finally a third official, Shaun Cain escorted Matt off the track without any contact or further incident.
Matt was then met by Security at the pit gate and escorted back to his pit area.

As Track Steward I work on the front stretch of the speedway. I observed the crash involving #42 Matt Ericksson and 39 Roger Selsor on the backstretch. after the cars stopped moving I observed Ericksson get out of his car and angrily approach the driver window of Selsors car, I was approaching the crash site and heard Ericksson cussing at Selsor and could hear Selsor responding but could nto understand what he was saying. I observed track official John Williams move between Ericksson and Selsor's car and tell Ericksson to move away. Erckson cussed again at Selsor backed away from the car and shoved Williams in the chest and cursed at Williams. At this point I began working on clearing the track of the crashed cars and did not see any other actions by Ericksson, or Selsor.

In the wreck on the back stretch involving Matt E (42 car) and Rodger S (39 car) I john Williams got to the 39 car first, asked if he was ok, he said yes, went to the 42 car, asked if he was ok, he was unbuckeling and cursing profoundly, he got out of the car, screaming and cursing at Rodger S.,at that time I stepped in the middle to avoid him from hitting rodger, telling him to be cool, he ran around to the driver side of the 39 car, reaching inside cursing and swinging at Rodger, I told him to get away from the car and go to the pits ,I was in between the driver door and Matt,told him to stop cool down again, at that time he straight armed me in the center of my chest, told him to leave, go back to the pits, at that time coop took over,

I'm the track EMT and I was working the infield safety crew on the night of 5-7-11. In the early stage of the Late Model race the 42, 39, and 14 cars went three wide out of turn two. The 42 car touched the wall with his right front and his left front hit the right rear of the 39 car causing the 39 to turn right. Both cars crashed hard bringing out the red flag.
I arrived as fast as I could get on the scene of the crash, and the driver of the 42 car (Erickson) was already out of his car heading towards the driver of the 39 car (Selsor). A Track official was standing in between Erickson and Selsor, at that time Erickson struck the official with a forearm in an effort to go past him to get to the other driver. The official turned Erickson away as soon a she got control sending him back to his own race car.
I approached Erickson at his car and asked him if he were ok, as track EMT my primary concern was his wellbeing at that point. His response to me was "f*#k you", he then pushed me in the chest. I instructed him to leave the track, and he pushed me again.
At this point another official arrived and got in between us to escort him off the race track. He walked him out the back gate of the race track, at that point a crew member of the 39 team said something at Erickson from a distance and Erickson turned towards him in anger. The security guard took Erickson into the pit area from there.
After the race was over the track promoter Kenny Shepherd called a meeting for all drivers that competed in the main event that night. I was asked to help escort all the drivers into the meeting room, and the father of Matt Erickson walked into the meeting room as well, he was asked by Mr. Shepherd to excuse himself from the meeting as it was for drivers only, Mr. Erickson, Matts father stated "I'm staying in here if not he (Matt) will kill someone." Mr. Shepherd convinced the father to leave the drivers only meeting. At this point I moved outside and the father walked up to me and began to curse aggressively at me.

When erickson got in koops face i jumped in between the two and told him u need to get off the track. He got in my face i turn him around and walked him off the track. I Cpl K. Sinks was in the main grandstands watching the late model race. On lap 3 car 39 turned into car 42 pushing this vehicle into the wall and observed sparks coming from car 42's right front tire when he hit the wall. Car 39 again turned into car 42 and both vehicles came to a complete stop adjacent to the entrance gate. I then ran to my vehicle and went to the back gate where I met Mat Erickson the driver of the 42 car coming out of the gate. I exited my vehicle and after getting to the gate I observed and overheard Donald the brother of the 39 cars driver saying derogatory and inflammatory statements to matt. I grabbed matt by the waist and stated " WALK WITH ME",. and he did with no problem.
While walking to his pit he was mumbling unintelligible statements under his breath that I was not able to hear.
Koop (track official) was exiting the gate and passed Matt by. Matt stated to Koop " I am not coming back" and Koop stated" then get your car and get the hell out of here". We continued walking to the pit area, and Matt got to his pit with no fighting or arguing with anyone. Debbie Gary came up and I asked her to stay with matt while I went back to the gate and see what else is going on and she did. I then got back to the gate to see what all was going on and the official's was working on cleaning up the mess. There was no other problems that I seen or was told about.

This is in response to the penalties that were imposed on the 42, 1st, it would have been nice to be notified of the penalty before finding it out from people sending us messages as to this, I thought we were to be told by a phone call first.
1. Striking an official(s)
This is not true no one was struck the only placing of hands on a person was done by your officials, after the wreck your officals came over to Matt put their hands on him he shoved their hand off of him, to touch him was not necessary and unfounded, he made no threat to anyone, he went to Rogers car and yelled at him. This was seen by persons that were there at the race, (if you would like to talk with these said persons let me know, I will provide you with names) He had the right to get their hands off of him. Kathy Sinks then had Matt the rest of the time, under no circumstances an official was struck. NO OFFICAL SHOULD TOUCH A DRIVER (PERSON) UNLESS IT GETS PHYSCIAL WITH THE DRIVERS WHICH DID NOT HAPPEN. THEY SHOULD STAND IN BETWEEN, MATT NEVER TOUCH ROGER
It would also be nice to know who are accusers are
2. Reckless Driving
Matt was not reckless driving, The #5 car pushed his way between the 41 & 42 before the 1st lap and continued to push the issue, they raced that way for 4 laps, and Matt passed without touching another car, he was about to finish the pass on the 39 on the outside line, when the 41 snuck in on the bottom of the 39, and then 39 made a right had turn into Matt forcing him into the wall which broke his brake line, 39 kept coming up turning into the wall, with no brakes 42 hit him causing 39 to be on top of 42, Radiator water was on the track at that point.
3. Unsportsmanlike conduct
Yes there was unsportsmanlike conduct, not debating that, but it took place from both drivers, and the crew from the 39, they meet Matt at the pit gate wanted to pick a fight, some stuff was said, but Kathy keep Matt with her and told the others to leave.
I am further wondering way Tony #5 can be on probation for ruff driving no fine or suspension, and is allowed to continue to driving like he does. The 21 car has hit several cars each week out there,(his is on probation) and continues to driving like he does also, these drivers and on probation NO fines of any kind SO WHY IS IT THAT MATT IS DEALT WITH SUCH SEVERITY? The other probation cars were driving rough and no penalty when they are one probation?
You can talk with Kathy Sinks, she was there, she saw the racing and was with Matt, we also can give you some more names as to the infield, Jillian saw the race also. Also there was a person watching the race and came up after the night and said that Matt did not do anything and that he wants us back out there, he gave us some money to help with putting the car back together, I hope that you talk with Kathy.

To all Mst drivers/owners,
The #3 Mst was DQ'd on 4/30 for un-approved brake components, specifically the brake drums. This decision was protested and the following determination has been made.
The drums in question are in fact legal per the Madera rules. The drums did come stock on SR5 Corollas with the heavy duty rearend/tow package. Although very rare, they are legal. This information was verified and confirmed by Toyota. They are listed in the Toyota parts catalog for the 76 Corollas. All of the points earned by the #3 Mst on 4/30 will be reinstated.
